GetJam terms of use & data agreement

Please read these terms and conditions carefully before using GetJam. You agree to the following terms and conditions (“Terms of Use”) when you join GetJam. My Air Media Limited are the company that operate GetJam.

Basic version (detailed version below)
 

1. You must be over 16 to use GetJam. GetJam is a FREE service and will NEVER charge anything to your mobile. There are no restrictions on how often you use GetJam or on how long at any one time.

2. We ask that on initial registration; that you provide information about yourself that is accurate and where details change you update your profile; this allows us to ensure we only provide you with content and offers that are relevant to you and to provide you with information you request.

3. Data agreement: My Air Media Limited respects your privacy and will look after your personal data. We will contact you if we need to concerning your account or your use of GetJam (for example if the incorrect PIN is entered into your account 5 times and we have to lock it). We will also update you from time to time about developments on GetJam, and will always give you the chance to opt out of these marketing emails. We will not share your details with anyone, except where you explicitly request or authorise us to pass on your email address, gender and date of birth to one of our brand partners as part of an offer where you can earn more berries. In this case, all communications from that brand partner will provide an unsubscribe option.

4. To qualify for berry reward points for using GetJam, users must ‘activate’ their account – this means logging into the GetJam player on their personal mobile, using the PIN that was sent to the user during the registration process. Activation is completed after one successful log in.

5. Berry rewards have no exchangeable monetary value. They can be redeemed for those product options available at the time of redemption.

6. Redeemable products are subject to availability; My Air Media Ltd will always endeavour to deliver the requested product as soon as is practically possible; however from time to time products may not unavailable. Where this is the case, you will be notified and an expected delivery date indicated.

7. Our content partners retain the rights to the intellectual property contained in content provided through GetJam; the download and consumption of content confers no rights on the jammer; you are not authorised to resell content, or further distribute it, except by the means enabled by GetJam called "spread jam"). Where jammers provide content to GetJam, the jammer retains the rights to the intellectual property contained within content.

8. General provisions including limits of liability, disclaimers of warranties, user conduct and indemnification are included in the detailed terms and conditions below:

Terms and Conditions (Detailed)
1. Definitions


1.1. A “jammer” is a registered subscriber to the GetJam service


1.2. “GetJam player” is the java application downloaded to the jammers mobile handset, or the Mobile Internet site that enables access to GetJam content and services “over the air”


1.3. “service” is the functionality and content provided by the GetJam platform including access to content, the ability to earn rewards and order products,


1.4. “sites” are the GetJam internet addresses; www.GetJam.co.uk and www.GetJam.mobi


1.5. “content” includes all images, audio, video, applications, text or other files featured through the “GetJam player” of “sites”


1.6. “spreadjam” is a service featured on the menu on the GetJam player that allows jammers to forward content to other parties
1.7. “berries” are the currency of the GetJam.mobi channel


1.8. “berry reward credits” are denominations of value that jammers can earn for undertaking activities on the GetJam service


1.9. “get spending” is the service featured through the menu on the GetJam player or on the site that allows jammers to order products bought with berry reward credits
1.10 “get fresh” is the service featured on the menu on the GetJam player that allows jammers to view non rewardable content


1.11 “get offers” is the service featured on the menu on the GetJam player that allows jammers to view offers available from our advertisers and other 3rd parties.

2. Subscription


2.1. GetJam is a free subscription service that is only available to users who have registered for the service


2.2. Subscription is entirely FREE of charge and entitles the jammer to unlimited use of the service


2.3. Subscription allows the jammer access to GetJam services and content through the GetJam player and access to the service via the site

3. Registration


3.1. Jammers agree to provide the information requested as part of the registration process and to ensure that this information is updated from time to time to keep it accurate


3.2. On registration the user will be assigned an account


3.3. The jammer will provide a PIN number required to log in to their account. The jammer is responsible for keeping their PIN confidential

4. Account Activation


4.1. An account becomes active once the jammer has completed the registration process, has downloaded the Java player to their mobile handset and logged in through their registered mobile, using a personal 4 digit PIN. Or when a jammer has logged in through the Mobile Internet site, using the designated 4 digit PIN.

5. Earning Berry Rewards


5.1. Berry reward credits can be earned by the jammer for performing a range of transactions on the service. The number of berries offered for performing transaction may vary from time to time. Rewards are variable by content item or sub-channel as indicated in the content description or at standard reward rates as indicated on the website.


5.2. To qualify for the berry credits indicated to be available the jammer must “complete” a qualifying transaction. These include, but are not restricted to:


5.2.1. Activation Bonus; where the transaction is completed once the jammer has completed the registration process, downloaded the GetJam player and logged in on their mobile handset, or registered and logged in on the Mobile Internet site.


5.2.2. Spread Jam; where the transaction is completed once the jammer has sent details of the service to another party through the mechanism and that party has then registered for GetJam using a specified email address or mobile number


5.2.3. Activity Bonus; where the transaction is completed once the jammer has completed the number of “qualifying” transactions within the time period available at the time or registration as described on the site


5.2.4. Content Viewing/Download; where a transaction is completed once the content has been viewed in its entirety or downloaded to the users handset


5.2.5. Content forwarding through spreadjam; where the transaction is completed when the jammer has forwarded content using the spreadjam service. The jammer is expressly permitted to forward content featured on spread jam to other parties where they use the mechanism provided by the ”spread jam” service


5.2.6. Promotion Download or action; where the transaction is completed when the jammer downloads the promotion to their handset or by answering 'yes' to a question from a brand.


5.3. Once the qualifying transaction has been completed, the jammers account will be credited with the number of berries indicated to be available. The crediting of the berries to the jammers account will be indicated as an increase in the berry balance shown on the berry counter. The balance will either be increased in real time, or when the jammer next logs back into the service and the “GetJam player” synchronises with the server.


5.4. Where the availability of rewards is limited, the limit is effected either by the availability of the transaction being limited or where the transaction continues to be available, the available reward being limited.


5.5 The maximum number of accounts per individual jammer is one. Jammers, who at My Air Media Ltd's discretion are deemed to have set up multiple accounts (for example using multiple phone numbers or SIMs) shall be deemed to be abusing the service. Where this is the case My Air Media Ltd shall be entitled to close the accounts of the user, retain the right not to fulfil redemptions and/or bar further use of the service).
Paypal accounts provided by users for the purposes of Paypal payments should be specific to that user. Jammers should not request Paypal payments be made to another persons account.

5.5. Redeeming Berry Rewards


5.5.1. Berries can only be exchanged for products offered through get spending. The products offered may vary from time to time


5.5.2. Berries have no exchangeable cash value. Berries cannot be exchanged for cash other than through the prescribed process for Paypal cash payments at the exchange rates and cash denominations prescribed at the time


5.5.3 Paypal accounts provided by users for the purposes of Paypal payments should be specific to that user. Jammers should not request Paypal payments be made to another persons account.


5.5.4. Orders; the jammer can place orders for products through get spending if they have sufficient berries in their account to make the purchase. Once the jammer has placed the order the berry cost of the product will be deducted from the jammers account.


5.5.5. Availability; All products ordered are subject to availability. In general rewards will be delivered to the user in real time (downloads) or batched for delivery in accordance with the stated service level. From time to time for administrative reasons requested rewards may not be available. In such cases products of equivalent value will be offered or the jammer notified when the product will again be available


5.5.6. If a Jammer account is not used for a continuous period of six months (180 days), My Air Media Ltd will place your account on inactive status and the berry balance will be reset to zero. An account can be reactivated, however, any berry credits accrued at that point will not be refunded to the account.

 

5.6. Privacy Policy


5.6.1. Personal Information: any information provided by the jammer on registration for the get service or otherwise through use of the service will be protected by My Air Media.


5.6.2. Data agreement: My Air Media Ltd respects your privacy and will look after your personal data. We will contact you if we need to concerning your account or your use of GetJam (for example if the incorrect pin is entered into your account multiple times and we have to lock it). We will also update you from time to time about developments on GetJam, and will always give you the chance to opt out of these marketing emails. We will not share your details with anyone, except where you explicitly request or authorise us to pass on your email address, gender and date of birth to one of our brand partners as part of an offer where you can earn more berries. In this case, all communications from that brand partner will provide an unsubscribe option.

6. General Provisions


6.1. Limit of Liability


6.1.1. Jammers are entirely responsible for their network charges. GetJam will provide as much information as possible regarding tariffs and network costs, but accept no liability for network cost incurred by users for use of the service


6.1.2. My Air Media Ltd will not be liable for any loss or damage arising either directly or indirectly from any use or inability to use the GetJam player, Mobile Internet Site, website or its content. In registering for the service you understand and agree that under no circumstances will My Air Media Ltd be liable for any damages whatsoever including but not limited to (i) any direct, indirect, incidental, consequential or exemplary damages arising out of or the inability to use the site or its content (ii) any claim attributable to errors, omissions, or other inaccuracies in the site or the content (iii) unauthorized access to or alteration of your transmission, data or settings (iv) statements or conduct of any third party on the site of the service or (v) any other matter relating to the site or content, even if My Air Media Ltd has been advised of the possibility of such damages


6.1.3. If you are dissatisfied with the service, site content or terms and conditions your sole and exclusive remedy is to discontinue using the site


6.2. Intellectual Property.


6.2.1. The player, sites, and all information and/or content that can be seen, heard or otherwise experienced on them, including without limitation all reports, text, video, graphics, audio, and other materials (collectively, the "Content") are protected by U.K. and international copyright, trademark and other laws, and belong to My Air Media Ltd or to third parties. You may use the Site and the Content solely for your personal use. You may download, print and store portions of the Content that you select for such use. No right, title or interest in any downloaded Content or materials is transferred to you as a result of any such downloading. My Air Media Ltd or featured 3rd parties reserve complete title and full intellectual property rights in any Content you download from the Site. You may not modify, reformat, copy, reproduce, display, distribute, repost, transmit, publish, license, sell, rent, transfer, or create derivative works from any Content or information obtained from the Site, except as expressly permitted by these Terms and Conditions. You are prohibited from using any of the marks or logos appearing throughout the Site without express written consent from the trademark owner, except as permitted by applicable law.


6.3. Disclaimer of Warranties


6.3.1. The GetJam service and site is provided on an “as is, as available basis”. You agree to assume total responsibility and risk for your use of the site and the content and for evaluating the accuracy, completeness and usefulness of all content. My Air Media Ltd makes no express or implied warranties, representations or endorsements whatsoever with respect to the service, site or content. My Air Media Ltd expressly disclaims all warranties of any kind, express, implied, statutory or otherwise, including, but not limited to implied warranties of fitness for a particular purpose, title and non infringement with regard to the service, site for content. My Air Media Ltd does not warrant that the functions performed by the site will be uninterrupted, timely, secure, error free or that defects of the service , site or content will be corrected.
6.4. User Conduct: Users agree to use the service and site only for lawful purposes. You agree not to take any action that might compromise the security of the service or site, render the service or site inaccessible to others or otherwise cause damage to the service, site or the Content. You agree not to add to, subtract from, or otherwise modify the Content. You agree not to use the service, site in any manner that might interfere with the rights of My Air Media Ltd or any third party.
6.5. Indemnification: You understand and agree that you are personally responsible for your behaviour on the service or site. You agree to indemnify, defend and hold harmless My Air Media Ltd, its affiliates, licensors, employees, and agents from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, indirect, incidental, consequential, and/or exemplary damages), and reasonable legal fees, resulting from or arising out of your use, misuse, or inability to use the service, site or the Content, or any violation by you of these Terms and Conditions

6.6 Governing Law and Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the law of England and Wales.
